Kumasi High Court Dismisses Conti-Katanga Injunction Application: University Proceeds with Admission of Female Freshers Into Katanga and Conti

The Kumasi High Court presided by Justice Diawuo has dismissed the injunction some students and alumni from both Unity hall and University hall filed to restrain authorities of the Kwame Nkrumah University of Science and Technology from converting both University Hall and Unity hall to unisex halls.

The Court couldn’t look into the substantive matter of the case, however he(Justice Diawuo) said , for the way that the Fresh students are as of now on Campus, holding up to be assigned to their rooms, the University will suffer reverting the affected halls back to single sex halls in the event that he ( the Judge ) do something else. However , the substantive issue is still under the watchful eye of the Court. At the point when it’s returned to and the students win the University needs to oust the females. The entire reason is that the Injunction was filed late.

Legal Interpretation.

The authorities of the university would proceed with admission of female freshers into the two male halls, however should the alumni and students of both University hall and Unity hall wins the case when it is revisited, the university would oust all female freshers and find a place for them.

The lead Counsel for Unity hall has said in an interview that he will put forth beyond any doubt the defense gets to the Supreme Court for some translation.

Background

The university in a statement made it clear that it is rather converting all traditional halls to mixed halls effective 2018/2019 Academic year instead of converting only Unity hall and University hall.

Unity hall, Africa hall and University hall were the only single sex halls among the six traditional halls including Independence hall, Republic hall and Queens hall until the university in a statement last semester converted Unity hall and University hall to mixed halls.

Inmates of University hall and Unity hall including its alumni have challenged the university to make a U-turn on its decision with threats, demonstrations and a lawsuit.

An injunction allegedly granted by the Kumasi High Court to cause a standstill of the decision looks fruitless as the university as stated in its statement has added Africa hall which was going to be the only single sex hall on campus to Unity hall and University hall as mixed halls.

The University in the statement stated clearly that its policy of expanding access to female students still remains unchanged.
